Confessions of an Expert Witness: What Gift Planners Should Know

What if all your files, including notes, emails, letters, proposals and agreements with a donor and their advisors were summoned by the court?  What story would they tell?  With the growth of estate litigation, it may just be a matter of time before that summons arrives at your office. This presentation will showcase the important role the gift planning professional plays in orchestrating a successful gift plan.  The quality of your fact finding is essential to the integrity of your file and impacts the level of trust you earn from the donor.  With a deeper understanding of the donor's goals and objectives, communication with their advisors is greatly enhanced and conflicts can be avoided.   There is no guarantee that someone won't bring litigation against the gift planning professional and/or the organization they represent, however, there is a best practice the gift planner can adopt to demonstrate that they provided a standard of care.
